People want to own your own home. It is a common aspiration. But in the current extremely tight credit market (think U.S. financial bailout), a potential buyer of the house may not be able to obtain financing from a bank or mortgage company. In this case, a buyer can opt for the purchase of real estate through a land contract.
A land contract sometimes known as a "contract labor" trust "facts" or an "agreement of hire purchase is a contract between a buyer and a seller of real property in which the seller provides financing to acquire the property for an agreed purchase price and the Buyer pays the "loan" in installments. The seller has the title or deed to the property until the buyer complete all payments stipulated in the contract.
Buying a property via a land contract can prove beneficial for the buyer. He / She has to contend with strong for payments, the requirements credit or other bank financing requirements tedious. The initial costs incurred with the land contract are also significantly lower than those through bank financing. Also, the seller does not have to wait long bench processes. Moreover, the goods sold through a land contract may have a higher price if sold through bank financing. Since the buyer is not obligated to pay a large down payment, the seller may ask for a price higher or a higher interest rate that it needs to achieve significant benefit.
Under a land contract, the buyer and seller enter in an agreement stipulating that the seller can only transfer the legal title to the property until all agreed payments have been paid in full. During the duration of the contract, the seller allows the buyer to occupy / use of property for purposes other than legal ownership provided the buyer is in arrears. In most of land contracts, the purchase price is generally paid with modest payment installments, then, for a specified period of time. At the end of flow of payments, the buyer pays the balance with a balloon or a lump sum payment. When the full purchase price including any interest has been paid bids seller the legal title to the property buyer.
If the buyer does not on its scheduled installment payment or not make full payment at the end of the land contract, the seller may re-possess the property. The buyer loses the payments, including payment and equity through their payments. The money and time spent improvements in the property to all go to waste. Thereafter, the seller is obliged to transfer the property title to the buyer.
Moreover, if the seller owes a mortgage on the property and has not settled the entire loan before the final payment to the buyer, at the end of the contract, he may be forced to pay the mortgage to avoid foreclosure on the property thereby losing his investment. Besides the mortgage on the property, may also be back taxes or other charges which the seller owes.
